Please read the following Terms and Conditions (“Terms”) very carefully. Your use of our website and services is subject to your full acceptance and compliance with these Terms. By accessing our website or making a booking, you confirm that you have read, understood, and are bound by these Terms. If you do not agree to the Terms, you must not use our services.

1. Definitions and Acceptance

1.1 Key Definitions

In these Terms:
  • “You,” “User,” or “Customer” refers to the end user accessing the Website, its content, and purchasing the Services.
  • “We,” “Us,” or “Our” refers to Heritage First Goa (HFG EDUCATION AND LEARNING FOUNDATION).
  • “Website” refers to your Internet-based booking platform, http://www.heritagefirstgoa.com.
  • “Services” refers collectively to the guided heritage walks, walking tours, and any other products offered through the Website.
  • “Service Providers” refers to independent third-party contractors or guides utilized by us to deliver the Walks.

1.2 User Eligibility

Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions, and notices contained in these Terms. We reserve the right, at our sole discretion, not to accept a User from registering or booking Services without assigning any reason.

2. Booking, Exactness, and Service Delivery

2.1 Services Offered

Heritage First Goa offers guided heritage walks and related cultural experiences through the Website. Upon placing an order, we shall reserve a ticket for the requested Walk product to you and be entitled to its payment.

2.2 Exactness Not Guaranteed (Operational Disclaimer)

We hereby disclaim any guarantees of exactness as to the finish and appearance of the final Walk/Service as ordered by the user. The quality and availability of any third-party services (e.g., venue access, external vendors) may not meet every expectation. Alterations to the Walk route, duration, guide assignment, or scheduled timing may be required due to factors like local events, weather, venue restrictions, or Service Provider availability. In such an instance, a representative will inform you via the contact details provided in your booking.

2.3 Customer Responsibilities (Tardiness)

  • You must arrive at the designated meeting point at least 10 minutes before the scheduled Walk start time.
  • A delay in arrival beyond 15 minutes from the scheduled start time will result in the booking being treated as a “No-Show,” and no refund will be issued (see Clause 3.2).

3. Financial, Cancellation, and Refund Terms

3.1 Pricing and Payment

All prices are listed in Indian Rupees (INR) and are subject to change without prior notice. Payment is due in full at the time of booking and is processed via secure third-party payment gateways.

3.2 Customer Cancellation and Refund Policy

All cancellations and refunds are strictly governed by our full Cancellation & Refund Policy, available at http://www.heritagefirstgoa.com/cancellation-and-refund. By accepting these Terms, you agree to the conditions, including the tiered refund schedule and the “No-Show” policy.

3.3 Shipping and Delivery

Since we deal exclusively with intangible services (digital bookings for physical walks), this service does not involve physical shipping. The “delivery” of the purchase is the instant email confirmation sent upon successful payment. 4. User Conduct and Rules

You agree and undertake to use the Website and Services only to post and upload messages and reviews that are proper and appropriate. You agree and undertake that when using the Service, you will not:
  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others.
  • Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful material or information.
  • Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto.
  • Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another’s computer.
  • Conduct or forward surveys, contests, pyramid schemes, or chain letters.
  • Violate any applicable laws or regulations for the time being in force in or outside India.
  • Violate any other terms and conditions of this Agreement.

5. Intellectual Property Rights

5.1 Ownership

Unless otherwise indicated, Heritage First Goa owns all Intellectual Property Rights to and into the Website, including, without limitation, all rights, title, and interest in and to copyright, trademarks, service marks, designs, text, content, and the unique structure of the Walks.

5.2 Limited Use

You agree and undertake not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website. Limited reproduction and copying of the content is permitted provided that Heritage First Goa’s name is stated as the source and prior written permission is sought. Unlimited or wholesale reproduction or copying of the content for commercial or non-commercial purposes is strictly prohibited.

6. Limitation of Liability and Indemnity

6.1 Limitation of Liability

Heritage First Goa, its guides, and Service Providers shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services. In any event, the maximum liability of Heritage First Goa for any claim shall not exceed the ticket price paid by the customer for the specific Walk.

6.2 Indemnity

You agree to indemnify, defend, and hold harmless Heritage First Goa, its affiliates, employees, and Service Providers from and against any and all losses, liabilities, claims, damages, and costs (including legal fees and disbursements in connection therewith) asserted against or incurred by us that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant, or agreement made or obligation to be performed by you pursuant to these Terms.

7. Governing Law and Policy Links

7.1 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Goa, India.
